TERMS AND CONDITIONS TYTO Auctions & Liquidators have listed the lots in this catalog for online only sale and is acting as an agent for consignor(s) or as owner. By bidding on this auction you agree to the these Terms of Sale. All items are sold "As Is" and without recourse to TYTO Auctions & Liquidators not their Consigner's Items are sold "As Is" "Where Is" with no expressed warranties or guarantees. All Sales are final and there or no returns for any item purchase. Buyer must come prepared for loading and moving of items. Buyer must bring their own help for loading and securing loads Failure to pay will cause forfeiture of items. Neither TYTO Auctions & Liquidators nor its Consigner(s) make any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalog or other description of the physical condition size, quality, rarity, origin exhibitions, literature or historical significance of any lot sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. No statement, whether written or oral and whether made in the catalog or in supplements to the catalog, and advertisement, bill of sale, salesroom posting or announcement, remarks of auctioneer or otherwise shall be deemed to create any warranty, representation or assumption of liability. TYTO Auctions & Liquidators and its Cosigner(s) make no warranty or representation, expressed or implied, that the purchaser/buyer will acquire any copyright or reproduction rights to any lot sold. TYTO Auctions & Liquidators expressly reserves the right to reproduce any image of the lot sold in catalog SALE DAY TYTO Auctions & Liquidators, at our complete discretion, reserve the right to refuse admission or participation in any auction and to reject any bid. Bids must be place in U.S. Dollars. The Auctioneer, at their absolute and sole discretion retains the right to refuse any bid, withdraw any lot and in the case of error or dispute, whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the lot in dispute. If any dispute arises after the sale, the sale of record of TYTO Auctions & Liquidators is conclusive and final. SUCCESSFUL BID The highest bidder acknowledge by the Auctioneer will be the purchaser. In the event of a dispute between bidders, the auctioneer has final discretion to determine the successful bidder or to reoffer the lot in dispute. If any dispute arises after the sale, the TYTO Auctions & Liquidators sale record shall be conclusive. Title passes upon the fall of the auctioneers hammer to the highest bidder subject to the Terms of Sale set forth herein and the bedder assumes full risk and responsibility AFTER THE SALE Buyer's premium, in addition to the hammer price, the buyer agrees to pay TYTO Auctions & Liquidators a buyer's premium and the applicable sales tax added to the final total. The buyer's premium for online bidders is fifteen (15) percent (%). The buyer must pay the entire amount due (including the hammer price, buyer's premium and all applicable taxes and other charges) no later than 1pm on the next business day following the sale. Payment in U.S. dollars, major credit/debit card. Credit and Debit card purchases are only permitted for United States buyers with invoices totaling less than $5,000. Buyer credits issued by TYTO Auctions & Liquidators expire one-year from issue. TYTO Auctions & Liquidators reserves the right to refuse a credit/debit payment from any buyer. Buyer's may present a full copy of their valid Indiana State resale tax identification or Indiana exemption identification number and have the invoice name match the certificate to waive sales tax. Collecting purchases once TYTO Auctions & Liquidators has received all funds due, the buyer shall collect purchased lots withing the designated times following the sale. Property which is paid for but left on premises for any reason in excess of designated pick up is considered abandoned and will become property of TYTO Auctions & Liquidators to use, dispose of or resell at our discretion. PACKING AND SHIPPING If your bid is successful and you choose shipping on any eligible lots, TYTO Auctions & Liquidators will directly ship select lots as noted in the catalog. The buyer is responsible for all postage, handling, insurance and confirmation fees in addition to cost of lot purchased. Packages shipped to multi-unit addresses or those valued at $300.00 or more require signature confirmation. Many of the lots require third party shipping and we can provide you with a list of shipping providers. TYTO Auctions & Liquidators will ship most lots withing 10 days following the sale. TYTO Auctions & Liquidators will not be responsible for the acts or omissions of shipping providers whether or not recommended by us. TYTO Auctions & Liquidators will not be held liable for any damage that occurs during shipping. Property will not be released to any shipping provider until payment has been made in full and has cleared the bank. NON-PAYMENT If we do not receive payment in full, in good cleared funds, withing seven (7) days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any actions available by law: a) to hold the defaulting buyer liable for the total amount due and to begin legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law. b.) to cancel the sale c.) to resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without reserve and with the purchaser liable for any deficiency, cost, including handling charges, the expense of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages. In addition a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain al collateral security for such a purchaser's obligations to us, any property in our possession owned by such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, or in the case of bank or cashiers checks and we have confirmed their authenticity. d.) to offset against any amount owed e.) to not allow any bids at any upcoming auction by or on behalf of the buyer. f.) to take other action as we find necessary or appropriate. LIABILITY CONDITION REPORTS TYTO Auctions & Liquidators is not responsible for the correctness of any statement of any kind concerning any lot, whether written or oral, nor for any other errors or omissions in description for any faults or defects in any lot. Neither the seller, ourselves, our officers, employees or agents, give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot, with regard to merchantability, fitness for a particular purpose, description, size, quality, condition, attribution, authenticity, rarity, importance, medium, provenance, exhibition history, literature or historical relevance. Except as required by local law any warranty of any kind whatsoever is excluded by this paragraph. All measurements and catalog descriptions are approximations and should not be relied on. PURCHASED LOTS If for any reason a purchased lot cannot be delivered in the same condition as at the time of the sale or should any purchased lot be stolen, or lost prior to shipping/pick-up, TYTO Auctions & Liquidators shall not be liable for any amount excess of that paid by the purchaser. LEGAL RAMIFICATIONS The rights and obligations of the parties with respect to these Terms of Sale, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the laws of Tippecanoe County in Indiana. If any part of these Terms of Sale is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent permitted by law. DISCRETION Any and all of the conditions may be waived or modified at the sole discretion of TYTO Auctions & Liquidators.
