Part II - WWII Battle of the Bulge Veteran Estate Auction Estate of Melvin & Bryte Faggart (Dec) OUTSTANDING ITEMS TO NOTE IN THIS SALE: We will be auctioning the 1942 Oregon State vs Duke Rose Bowl College Football Game Program and a commemorative Cannon Mills Towel from this game.  The 1942 Rose Bowl was the 28th edition of the college football bowl game, played on Thursday, January 1. All sales are final. Absolutely no refunds are given. The sales records and recordings shall be conclusive. It is the bidder's responsibility to determine the exact condition/authenticity of each item. No statement in this catalogue or by representatives of Summer Hill Auction Company shall be considered as a warranty or assumption of liability. Written and oral descriptions given by Summer Hill Auction Company or staff members are given in good faith and a courtesy to the bidder/client, descriptions are only a matter of opinion, and should not be considered as a guarantee of age, composition, or authenticity. All measurements, descriptions and quantities are approximate and made to the best of our knowledge. Terms & Buyer's Premium: All accounts must be settled at the conclusion of the auction. There is a 15% buyer's premium for Summer Hill Auction Company online bids. Credit cards will be processed at the conclusion of the auction for your purchases, plus buyers premiums, and any taxes. All bidders must register with a Mastercard or Visa. Information subject to change. All lots sold "as is" "where is" with all faults, imperfections and errors and description. No credit or charge back will be allowed. All sales are final. The auction company is not responsible for accidents, theft, errors or omissions. Buyers assume complete responsibility for care of each purchase at time of sale. Announcements made day of the sale take precedence over written advertising or prior verbal statements. All accounts must be settled at the conclusion of the auction. A pre-auction authorization will be performed to establish available credit. Debit cards may show a hold on funds for a short period of time. Nothing will be charged to your card until a purchase is made by the bidder. In the event of insufficient funds a $25.00 fee will be imposed. There is a balance limit of $1,000 maximum charge to credit cards. Any balance over $1,000 will require payment by cash, certified check or bank wire. Any purchases over $500 will require certified check or bank wire to ship item/items. All purchases may be picked up/removed upon receipt of payment in full. Pickup, Loading & Shipping: All items must be picked up during specified pick up times. Please note there will be no shipping available for large furniture pieces. It is the buyer’s responsibility to check all contents of the package before removing it from the premises. We will not be held liable for damaged or missing pieces once the package is in possession of the bidder. It is your responsibility to review your purchases and their condition. Loading purchased items is the responsibility of the buyer. Summer Hill Auction Company does not provide labor or equipment to move items from the sale location. Buyers are responsible for packing smaller items; and dismantling, moving and loading furniture. Please make sure you have your own packing material and labor to collect and load items. Summer Hill Auction Company will have no liability for any damage in the event any loading assistance is provided. Please note that pick up is the sole responsibility of the buyer. Any items that have not been picked up with 5 business days following the close of auction will be considered abandoned, and no refunds will be given. We reserve the right to ship items not picked up at the buyer’s expense. Summer Hill Auction Company, through the United Parcel Service, can arrange packing and shipping at the buyer’s expense in addition to a $5.00 handling fee (additional fees may apply for large or heavy items). All items will be insured for the purchase price. Bidder may be required to verify information on high value shipments. Any purchases over $500 will require a certified check or bank wire to ship. If you reside in a state or country that has import restrictions or regulations, it is your responsibility to obtain appropriate licenses to ship your purchased items. All packing, handling, shipping, and delivery services are performed at the sole risk of the buyer. The Buyer assumes full responsibility and liability for any claim or actions based on or arising out of injuries, death, damage, loss of property, sustained or alleged to have been sustained by Buyer, its agent, principals, associates, friends, family and/or employees, in connection with or to have arisen out of or incidental to the auction including but not limited to the performance of this contract. Regardless of whether such claims or actions are founded whole or in part upon alleged negligence or negligent misrepresentation of Seller, Auctioneer, or the employees, agents, invitees, or licensees thereof, Buyer agrees to indemnify and hold harmless Seller, Auctioneer, and their representatives, and the employees, agents, invitees and licensees thereof in respect of any such matters and agrees to defend any claim or suit or action brought against Seller, Auctioneer, and their representatives, and the employees, agents, invitees and licensees thereof. This Agreement and all documents and instruments referred to herein shall be governed by the laws of the State of North Carolina. Any disputes between the Seller and Purchaser regarding this Agreement will be decided exclusively by a Court based in Cabarrus County, North Carolina. Outages: We are not responsible for Internet nor platform outages during an online Auction. If there is a platform outage during the close of an Auction, we reserve the right to no-sell the items affected during outage and offer for resale at a later date.
