All Purchases are subject to Florida Sales Tax unless purchaser possesses a sales tax exempt number. When requested, bidders may be required to maintain a 25% deposit at all times. Note to Internet Credit Card Users: If your purchases total over $1000 you will need to pay by Bank Wire or Cash Following Business Day. Please be sure we can contact you post auction the following workday and your credit card has a balance to cover your buys. The auction has to be audited and payments made to consignors or court trustees. Not having funds readily available will cause the auction office to remedy the situation with all avenues of recourse. There will be fees for time expended to collect and repeat offenders will no longer be allowed to bid online. Checks without Bank Letter will be accepted, but may be held until checks clear, and/or credit has been established with Bay Area Auction Services, Inc. Wire transfer will also be accepted. EVERY ITEM MUST BE PAID FOR IN FULL IMMEDIATELY FOLLOWING THE AUCTION – NO EXCEPTIONS. 2. EVERY ITEM IS BEING SOLD “AS IS, WHERE IS” WITH NO WARRANTIES, REPRESENTATIONS, OR GUARANTEES OF ANY KIND, EXPRESSED OR IMPLIED. Buyer shall rely on their own estimation and judgement of each item, including condition, authenticity, value, age, and all other. No allowance will be made or sales set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. 3. The Auctioneer reserves the right to (A) Accept bids in any increment he/she feels in the best interest of his client, the seller. (B) Reject bids from anyone whose conduct, actions, bidding, or adverse comments are not in the best interest of the seller or other bidders. (C) Withdraw from sale any items not listed or to sell at this auction, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. (D) If any disputes arise between two or more bidders, the auctioneer may decide the same, or may immediately put the item up for sale, and sell to the highest bidder. The decision of the auctioneer shall be final and absolute. ***Live internet bidding associates are on auction premises for the sole purpose of working with live internet bidders to post their bids competitively with other live floor bidders and live internet bidders. They are not clerking the live auction. Bay Area Auction engages experienced staff positioned directly adjacent to the auctioneer to physically clerk auction results - the selling price and winning bidder number - as they happen on paper, then those results are entered into database for customer checkout. Final results posted on live internet bidding site may sometimes differ from the final results as they actually occur at live auction, and are not intended for use as final Sales Summary record - which is provided to all consignment customers with payment. *** 4. Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release the auctioneer from liability therefore. Neither auctioneer nor his principal shall be liable by reason for any defect or condition of the premises on which the sale is held. 5. ALL ANNOUNCEMENTS AND/OR CHANGES FROM THE AUCTION BLOCK WILL SUPERCEDE ALL ELSE, REGARDLESS OF ANY CIRCUMSTANCE OR WRITTEN OR VERBAL STATEMENT FROM ANY SOURCE. THE AUCTIONEER IS ACTING AS AGENT ONLY AND IS NOT RESPONSIBLE FOR ACTS OF ITS PRINCIPALS. Re: INTERNET TIE BIDS; An ONLINE INTERNET Bid that ties against another ONLINE Internet bid the software will automatically award the tie to the earliest bidder. With a Webcast auction it is different. If a LIVE FLOOR bid comes in and ties a non accepted or unrecognized ONLINE bid then the floor wins. eg: Online bidder has a MAX Bid set to $200 and the bidding was started at $100 online then the floor jumps to $200. Floor bid wins. It rarely happens and is disappointing. So the best is really bid your Max. The Computer Server will Proxy bid for you as needed. If you are willing to go that extra $25 or $100 more then you need to set your Max at that. If you want to set your absolute Max as a starting bid we must know prior to the auction start. If not we will let the server proxy bid for you up until your Max has been reached or you are outbid by a floor bidder. Internet Bidders Please wait until the office calls and confirms you are the winning bidder. We cannot process the winners until the end of the auction. By signing up for a bidder number either onsite or online you as the bidder agree to our rules and conditions. You understand and agree there is no warranty or guarantee of any item. All property is sold AS IS, and ALL SALES ARE FINAL. Property is open to public inspection. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Bay Area Auction Services may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Bay Area Auction Services be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Bay Area Auction Services shall endeavor to describe in detail each item and any pertinent information about it. Bay Area Auction Services will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. * Bidder agrees that everything is sold as is and that they may not return any item they purchase... * Some items may have a reserve price to attain or are subject to price approval before they can be sold. The online software will show if the high bid has not met a reserve if there is one. Bidders further agree Bay Area Auction Services will not be held liable for any direct, indirect or consequential damages due to computer errors, connections online, missed floor or internet bids. The auctioneer has final word and determines the outcome of all bidding. There is also a 16% Buyers Premium to be added to the purchase price.
