Terms and Conditions - To Bid and Buy
REGISTRATION & IDENTIFICATION: At the time of registration, we may collect information about you to verify who you are before you can bid. All bidders must be of legal age of majority in the province or state they reside in orderx to bid.
REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime. Note that no bids can be withdrawn after the auction for any reason. All items are sold as is, where is, with all faults.
BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications may not be sent out during the last two hours of the sale so it is still your responsibility to track your bids.
WINNING NOTIFICATION, INVOICING & PAYMENT: All winning bidders will receive an e-mail invoice within 1 business day after the auction closing. All registered credit cards will be charged at that time. Normally if a customer wishes to pay cash, it can be noted when registering for our auctions. In light of the current COVID-19 situation we ask that customers DO NOT PAY BY CASH when picking up. If cash is the only option available, special arrangements can be made at the discretion of JD Buy & sell and will be handled on a case by case basis. We have added the option of E-TRANSFER for those customers that do not wish their credit card to be charged. When signing up for our auctions please enter 'ETRANSFER' under 'YOUR NOTES TO THE AUCTIONEER' section. If you are a succesful bidder/buyer, directions on how to etransfer the money will be emailed to you along with your 'unpaid' invoice. We thank you for your cooperation.
Dates and times for pickup will be posted on the auction. Customers will book appointment pick up times on the allotted pickup days and will have a specific time window to complete their pickups. We kindly ask that you kindly adhere to the new measures outlined for our pickup dates. Please note: Removal of all goods shall be at the expense, liability and risk of the buyer. Our staff cannot assist in the removal or loading of items. We will only move the items to our new curbside pickup bins/containers. You must provide your own labour to load your vehicle. We will package and box your orders as best we can while subject to the limits and dimensions of our pickup bins. Items may be boxed and/or loose within the bins.
Any item not picked up during the posted pickup times will incur a $20.00 late/storage administration fee and any items are not picked up within 14 business days after auction close will be considered abandoned and will be disposed of at a minimum $10 per item ($150 for pallet lots) disposal fee based on the actual costs to dispose of your items on top of any accumulated late/storage fees lot fees, buyers premium and taxes. Items are sold as is, where is, with all faults. If you choose to abandon an item after any auction, you will be blocked from placing any further bids on any of our future auctions. In certain cases special arrangements can be made for pickup/removal of items outside of the posted pickup/removal times. These arrangements may be subject to a service charge that is agreed to between the customer & JD Buy & Sell.
SHIPPING
As mentioned above we are offering local delivery for a flat rate of $6.00 per delivery
Customers who are outside of our local delivery area (at the descretion of JD Buy & Sell ) can choose to have their items shipped to a valid address in Canada only. Prior to the auction, if the customer knows they do not intend to pick up their order and needs their order to be shipped, please enter SHIPPING under 'YOUR NOTES TO THE AUCTIONEER' section when registering for the auction.
For all shipments outside of our local delivery area, JD Buy & Sell will use Canada Post 'Regular Parcel' service for your shipments. If a different level of service is required, a request must be made by the buyer.
Please note: Not all items are suitable/eligible for shipping. Large, bulky or heavy items will not be eligible for shipping and are subject to the discretion of JD Buy & Sell. Rates are based on those posted on the Canada Post Website. The exact charge will be the posted rate from Canada Post plus a $2.00 service charge for a total charge that will be invoiced to the customer. Any additional fees for shipping (higher level of service, insurance, signature options) will be charged only upon agreement between the buyer and JD Buy & Sell.
JD Buy & Sell also offers a delivery service available to select locations within York and Simcoe Regions. The cost of this service depends on address/location and weight and size of order. Charges will be calculated on a per case basis and agreed upon by JD Buy & Sell and the customer. Delivery times vary. This service offers a cost savings to the customer, based on rates that are generally 15% to 40% lower than the Canada Post published rates (subject to dimensions, weight and physical address).
Charges for shipping/delivery may be invoiced to the customer on a separate invoice other than that from the original auction.
CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an 'as is, where is' basis, with all faults. We strongly encourage all bidders to personally verify the condition of each item. No responsibility is assumed by JD Buy & Sell or the consignor for any errors or omissions.
CLAIMS: No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults.
PERSONAL & PROPERTY RISKS: We will not be liable for damage or injury to individuals or their property.
ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction.
BUYERS: The BUYER expressly agrees to indemnify and save JD Buy & Sell, the Seller and their consignors harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of JD Buy & Sell or anyone acting in his/her behalf in connection with or arising out of any auction. All bidders/buyers must be of legal age of majority in the province or state in which they reside order to bid at one of our auctions.

RESERVE: If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', you will be required to pay a minimum amount in order to win the item.
AUCTION RECORDS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records.
SOFT CLOSE: Items close at regular intervals. All bids made in the last 2 minutes of the auction will force an item to be extended by an additional 2 minutes. This will continue until all bidding has stopped.
STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.
CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an 'as is, where is' basis, with all faults.
PRIVACY POLICY: Your personal information is collected through our contact forms only. This website currently has no applications or programs that gather information from your computer without your consent. Users are required to give us contact information (e.g., address, phone number and email address) and demographic information (e.g., your postal code). Certain information, such as your email address, is collected in order to verify your identity and for use in our records. Under no circumstances will your e-mail, phone number or address be sold to, or given to any other parties. By bidding you are acknowledging agreement with the terms above. Please do not bid unless you agree to all of these terms.

When you bid on JD Buy & Sell auctions you are acknowledging agreement with the terms above. You must be of legal age to bid and do not bid unless you agree to all the above terms.
