TERMS & CONDITIONS BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS AND CONDITIONS AS STATED BELOW. IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO BIDDING. Online Bidding This is a timed, Online-only Auction; the highest bid online when the bidding closes will be the winning bid for the item. This auction will incorporate a "SOFT CLOSE". Bidding within the last 1 minute before the closing of an item will extend the bidding time by an additional 2 minutes. This prevents individuals from placing a bid on an item at the last second in order to prevent others from bidding more. Items Sold "As Is, Where Is" All items are sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Winter Equipment online auctions. Bidders accept all auction items/property "WITH ALL FAULTS", whether or not immediately apparent. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible, but do not represent any guarantee by the seller or Winter Equipment online auctions. By placing a bid, bidder signifies that they have inspected the item to their satisfaction. Pictures and Item Descriptions Multiple photos will be included in item descriptions whenever possible; however, photos may or may not fully represent the item. Lighting, surroundings and other factors can affect the perception of an item in a photo; therefore, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Photos and descriptions are to be used as a guideline only. Email Bidders who register for any auction will be added to our mailing and email lists. By agreeing to our terms and conditions, bidders agree to opt-in to each list. Email or mail recipiants may opt-out at any time. Auction Software Winter Equipment online auctions will not be held liable for any software or software malfunction discrepancies. Invoicing An invoice and payment instructions will be sent to each buyers registered email at the close of the auction. Please read email message completely for payment instructions. Please contact us at (507) 236-0903 if you do not receive an invoice from us within 24 hours of auction close. Payment Payment must be received at time of checkout and pickup following the conclusion of the auction. If payment is not received or payment arrangements made within 3 days after the conclusion of the auction, the buyer will lose all right, title and interest to the item(s), including any and all monies. Auction items will not be released for pickup until payment is made in full. Failure to comply with these terms will prohibit bidder from participating in future live or on-line auctions conducted by Winter Equipment online auctions. Item Pickup Removal and/or transportation of item(s) won on auction shall be at the expense, liability and risk of the buyer. Any Items not removed at the alotted checkout time, unless arrangements have been made and agreed upon by seller, will be considered abandoned and the purchaser will lose all right, title and interest to the property, including any and all moneys from the buyer. Returned Check Fees A fee of $35.00 will be assessed on returned checks and may result in the bidder being denied access to future auctions. Be sure you are capable of paying immediately after the conclusion of the auction and realize your bids are not conditional upon financing. Payment Procedures Payments will be made directly to Winter Equipment online auctions. Payment is to be made during checkout times and dates. Forms of payment: Cash, Cashier's Check, Wire transfer (with $20 fee), or Credit Card (with a 4% convenience fee for use of a credit card). All Cashier's Checks are to be made payable to Winter Equipment online auctions Shipping: Winter Equipment online auctions will have shipping available for most items at the expense of the buyer. Winter Equipment online auctions will charge a fee for package handling. Buyer agrees to assume any and all risk of loss, damage, or other unforseen issues with shipping and agrees to release Winter Equipment online auctions from any liability there of. Buyers will be responsible to bring any and all boxes, packaging materials, etc that may be needed at pick up. Buyers premium will be on a sliding scale as follows: 7.5% on a per item basis from $5001 and up with a $1000 cap per item 10% on a per item basis over $1001 and up to $5000 15% on a per item basis under $1001
