Auction Terms & Conditions REGISTRATION: All information provided by bidder during the registration process must be current, complete, and accurate. Bidders must be 18 years of age or older. DaweCo Auctions at its sole discretion may deny registration to any person or entity. ITEMS AND LOTS ARE SOLD AS IS: WHERE IS and WITH ALL FAULTS: Bidder acknowledges that all items and lots were available for inspection prior to the auction and, by these terms, DaweCo Auctions and Owner/Seller strongly encouraged Bidder to carefully inspect each item or lot to determine the nature, quality, condition, quantity and size of the item or lot. BUYER'S PREMIUM: Unless a specific auction states otherwise, a 13% buyer's premium will be charged on all items and lots. Every bidder pays the same buyer's premium and should bid accordingly. For example, if you bid $100 on an item at the auction you will be charged $115 for the item on your auction invoice. Payments with Credit Cards will have a 3% convenience fee added. SUSPENSION / PERMANENT BAN: A Bidder will be suspended or permanently banned from the Site for providing false or fraudulent information when registering. A Bidder will be permanently banned from this Site for failing to honor an auction bid made under that Bidder's bid number. PAYMENT: ***SPECIAL UPDATE: Payments must be made by ONLINE credit card or wire transfer only, NO IN-PERSON PAYMENTS (due to Covid19). ALL INVOICES WITH A TOTAL OF $1,500.00 or LESS WILL BE PROCESSED THROUGH THE CREDIT CARD USED FOR REGISTRATION FOLLOWING THE AUCTION CLOSE. If you incoice total is more than $1,500.00 you must respond to DaweCo Auctions before 5 pm the following business day with an alternate payment method (wire transfer or Credit card) Otherwise your card on file will be processed.*** ***The 3% Credit Card Convenience fee will be added to the buyers premium making it 15%. ***A wire transfer fee of $25 will be added to invoices paid by wire transfer Titled items will be subject to a $150.00 Dealer Documentation Fee. This is a negotiable fee. By placing a bid this fee is considered to be accepted. Any item or lot not paid for in full by the stated deadline will resort to suspension or permanent ban of bidder number. Bidder Credit or Debit Card used to register may be processed for payment. Ownership of your items will revert to Owner/Seller who may re-sell or dispose of items at Seller's discretion. CONDITION OF ITEMS: a) ALL ITEMS ARE SOLD "AS IS, WHERE IS". We make no representations or warranties with respect to the items in our auctions. We recommend you inspect any items you would like to buy before bidding. b) No deduction will be allowed on damaged articles, as all goods being exposed for public exhibition are sold "as is" and without recourse. RESPONSIBILITY AND OWNERSHIP: a) Every item becomes the responsibility of the new owner as soon as the online auction is concluded. If you are the highest bidder, you are responsible for insuring your purchase immediately. b) Buyer should come prepared to pack and load their items. We may be able to assist but cannot guarantee staff will be available to assist everyone. REMOVAL: The date by which all merchandise must be removed from the premises is posted on an auction-by-auction basis. THERE ARE NO EXCEPTIONS TO REMOVAL DEADLINES!! Bidders who fail to pick up purchases by the removal deadline may incur storage fees in the amount of $10.00 per day per item and/or be transported off-site at buyers expense. Items remaining after removal deadline will be considered as abandoned, and ownership will revert to Seller, who may resell or dispose of items. Any funds paid will be forfeited for failure to abide by the terms of sale. ADJUSTMENTS: .DaweCo Auctions reserves the right, for any reason, in its sole discretion, to terminate, change or suspend any aspect of the auction sale. TERMINATION OF AGREEMENT: This Site User Agreement constitutes a binding agreement between Bidder and DaweCo Auctions until terminated by DaweCo Auctions. DaweCo Auctions may terminate this agreement at any time, without notice. If Bidder dissatisfaction occurs with the auction sale in any way, Bidder's only recourse is to immediately discontinue use of the auction Site. DaweCo Auctions reserves the right to terminate Bidder registration and use of the auction Site, without notice or penalty. INTERRUPTION OF SERVICE: DaweCo Auctions cannot, and will not, be held responsible for any interruption in service. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. DaweCo Auctions, in its sole discretion, may void any sale, and re-sell any items or lots that were affected by any malfunction. PRIVACY: DaweCo Auctions gathers information about Bidders and Owner/Sellers for the purposes of conducting online auctions. DaweCo Auctions does not sell or rent this information. DaweCo Auctions uses electronic mail mailing lists to notify its customers about upcoming auction events only. YOUR BID IS A LEGAL CONTRACT: As a Bidder, placing a bid is a binding contract between you and the Owner/Seller and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this Site, and winning, then not paying for the product is illegal in most states, and prosecution can result. The Owner/Sellers of property sold through this Site reserve the right to reject any and all bids, in their sole discretion.
