Outlined below are the Terms & Conditions of Sale for this Auction. Please read them carefully. By placing a bid, you are acknowledging your acceptance of these Terms and Conditions of Sale. Conditions of Sale 1. BINDING TERMS The lots listed in this auction will be offered by Handline's Auctions as agent for consignors subject to the following terms and conditions: whereas, Handline's Auctions as agent, facilitates the contract and terms of sale between seller and buyer. The following Conditions of Sale constitute the entire agreement with the purchaser relative to the property listed in this catalog. By bidding at auction you agree to be bound by these terms. 2. AS IS Handline's Auctions, in our continued efforts to present potential buyers with the most accurate and valid data each lot offered was evaluated by a G.I.A. Graduate Gemologist who is a Ph.D., material scientist, and published researcher in gemology and gem resources. His expertise was invaluable to us in establishing the identity of gemstones and assayed metals, calculating estimated carat weights, and determining other parameters of each item but should not be used as a statement of condition. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Handline's Auctions shall have no responsibility for any error or omission. All lots are sold "AS IS" and without recourse and neither Handline's Auctions nor its consignor makes any warranties or representations, express or implied, with respect to such lots. Prospective buyers are strongly advised to examine, personally, any property in which they are interested, before the auction takes place, to determine its condition, size, and whether or not it has been repaired or restored. Neither Handline's Auctions nor its consignor makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging; nor does a reference to particular defects imply the absence of others. Neither Handline's Auctions nor the seller is responsible in any way for errors or omissions in the auction entry or any supplemental material. Buyers are responsible for satisfying themselves concerning the condition of the property and the matters referred to in the auction description. 3. WITHDRAWAL Handline's Auctions reserves the right to withdraw any lot at any time prior to the commencement of bidding for such lot and shall have no liability whatsoever for such withdrawal. 4. RESERVES Handline's Auctions will be presenting ALL lots in this auction, at the direction of its client/seller, at NO RESERVE. All lots will open at $1.00(US) regardless of market value and bidding will follow the pre-defined BIDDING INCREMENTS for this sale only. Bidders who place Maximum Bids may not have their highest bid executed is it is not aligned with the BIDDING INCREMENT. 5. ESTIMATES Each lot in the auction is without estimates for the purpose of resale. Handline's Auctions believes the value of any item is at the sole discretion of the public and will be determined by the winning bidder of each lot. 6. PURCHASER'S RESPONSIBILITY Title passes upon the designated closing time for each auction lot to the highest acknowledged bidder, subject to the conditions of sale set forth herein. Such bidder there upon assumes full risk and responsibility there for (including, without limitation, liability for or damage to the item). When making a bid, a bidder is accepting personal liability to pay the total purchase price. The total purchase price to be paid by purchaser is the amount of the successful bid price plus a premium of 15% (This number INCLUDES the 5% premium for Invaluable.com). Purchaser is also responsible for shipping charges, shipping insurance, Shipping delivery confirmation, and any other shipping charges requested by the purchaser. All purchases are subject to Cuyahoga County, Ohio's 8% sales tax. The purchase price will be paid through Wepay not later than 48 (forty-eight) hours following the time stamp of the auction invoice being sent, regardless of when the invoice e-mail is received, opened, or viewed by the purchaser. The buyer will not acquire title to the lot until we have received all amounts due to us from the buyer in good cleared funds even in circumstances where we have released the lot to the buyer. 7. LIMITED LIABILITY If for any cause a purchased lot cannot be delivered in as good condition as at the time of sale, or should any purchased lot be stolen or mis-delivered or lost prior to delivery, Handline's Auctions shall not be liable for any amount in excess of that paid by the purchaser. We are not responsible for the acts or omissions of carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased lots by us is at the entire risk of the purchaser and Handline's Auctions will have no liability for any loss or damage to such items. 8. CONTRACT DISPUTE By bidding via AuctionZip/Invaluable you agree to be bound by the terms and conditions of sale of those entities in addition to the Condition of Sale as outline. If any part of these Conditions of Sale is found by any court to be invalid, illegal or unenforceable, the balance of the conditions shall continue to be valid to the fullest extent permitted by law. 9. PAYMENT All payments must be made through Wepay on the bidding platform or, for those who will be picking up their winning lots in person, payment must be made using Wepay prior to pickup or by cash at time of pickup. 10. SHIPPING In our best effort to insure all auction items arrive to winning bidders in the same manner in which they were viewed for auction, ALL items are shipped using USPS Priority Mail with Adult Signature Confirmation and Insurance for the full invoiced amount in the continental United States (rates can be viewed online). Buyer's who win more than one lot and, at the discretion of Handline's Auctions, require a larger box to insure safe shipment will be charged in accordance with the necessary upgrade in USPS Priority Mail shipping and associated fees. All buyers from outside of the continental United States may have a delay of up to five business days before receiving an invoice while their lots are being packaged and calculated for shipping. 11. BUYER'S PREMIUM Handline's Auctions charges a premium of 15% to the buyer on the final price of each lot on the invoice for each buyer. 12. TAXES Applicable sales tax will also be added to the final total. Cuyahoga County, Ohio sales tax is charged on the hammer price and buyer's premium on any property picked up or delivered in Ohio State, regardless of the state or country in which the purchaser resides or does business. 13. ONLINE FORMAT Handline's Auctions does not guarantee that live Internet bidding will be uninterrupted or without error, or that Internet bids will be received. 14. PICK-UP If you intend to pick-up your item from Handline's Auctions location in Berea, Ohio, pick-up must take place March 24th Times and Location will be on the Winning Bidders Invoice Your Pickup time will be from 3pm -7pm on March 24th. We will only be allowing the winning bidders 1 at a time. We will also have an Officer on site for Security. This will be a ONE DAY ONLY PICKUP ONLY. NO EXCEPTION WILL BE MADE. If you are a winning bidder and are unable to pick-up your item(s) at our location, your items will be shipped as soon as funds are received and cleared by Wepay. You will be charged in accordance with Section 10 above ("SHIPPING".) The above-stated Terms & Conditions of Sale cannot be altered except in writing by The Auctioneer.
