HIDDEN TREASURES Terms and Conditions of Auction SaleThe consignee acknowledges that that the items presented for auction are to be sold in Hidden Treasures auction only and may not be cross sold on other sites. The consignee acknowledges that a 30% consignee fee is charged on the bid price. The buyer acknowledges that a buyer’s premium of 13% is charged on the bid price for credit/debit card users and a 10% buyer’s premium is charged for cash payers. Furthermore, this is a binding contract for consignors and buyers. Any consignor or buyer who fails to accept the contract will be forfeited from further consigning or purchases from the auction and collection effforts may be used by Hidden Treasures. All bidders must register and agree to the Terms and Conditions in order to have bid access. The purchase price shall be paid in either cash, debit card or credit card only (fees as stated above). We accept Visa, MasterCard and Cash. No checks or any other form of payment is accepted. All sales are subject to California state sales tax. Those with a valid resale number will be exempt from sales tax as long as the information is presented prior to purchase. Upon auction end, the bidder is to pay required winning bid amount and winning items are to be picked up within 48 hours of auction close. It is up to the discretion of Hidden Treasures to allow pickup beyond 48 hours. Bidders are allowed and encouraged to view all interested lots on open viewing days prior to bidding. All goods are to be sold “as is ” with no warranties or guarantees either expressed or implied. Any lots not picked up by the buyer’s will incur a $5.00 storage fee per day up to a maximum of 5 days. If the items are not picked up within 5 days, the buyer will be in default. If buyer is in default of payment or removal of winning items, such items may be re-posted for auction at the discretion of Hidden Treasures and the consignee. In case of default, the lot or lots so purchased may at the absolute discretion of the Hidden Treasures be immediately re-offered for sale and re-sold. No error or misdescription or deficiency in quantity shall void the sale and the purchaser shall be bound to take delivery of the lot without any allowance or abatement in price. Intending bidders must satisfy themselves by inspection or otherwise as to the nature of the lot or lots offered for sale and must accept same with all fault, patent or latent (if any). Furthermore, no warranty shall be implied from any affirmation made at the auction or otherwise. Each lot shall lie at the buyer’s risk from the fall of the hammer and neither the auction house nor the seller shall be accountable for any deficiency, damage or loss which may arise thereafter. The property in such lots shall not be removed until payment in full is received. Bidders must have satisfied themselves by inspection or otherwise as to the condition of the lot or lots sold. No matters will be entered once lots are removed from the sale site. Hidden Treasures reserves the right to add, change or remove lots. Minimum bid and reserve amounts are at the sole discretion of Hidden Treasures without any prior notice to consignors, buyer's or bidders. Hidden Treasures disclaims liability for any injury or damage to any persons or property resulting from any cause whatsoever, occurring in or about the sale or premises. Any misunderstandings or disputes in the consigning or bidding will be settled by Hidden Treasures. Any and all matters not expressly addressed in this terms and conditions is solely the decision and discretion of Hidden Treasures management. **ALL SALES ARE FINAL**
