Pre-Owned Motorcycle Auction Live & Online April 28, 2018 – Grand Prairie, TX Auction Terms & Conditions 1. This is a Public Auction. Prospective bidders must agree to these terms and present a valid driver’s license or acceptable photo I.D. to obtain a bidder card. There is no charge to register. 2. Payment must be made to the dealership on auction day by Cash, Cashier’s Check, Personal Check, Wire Transfer, VISA, MC or pre-approved Harley Davidson financing. No bank drafts accepted. Purchases may not be removed until paid for in full. 3. Online Bidders must read and agree to these Terms & Conditions. Participation requirements: Valid Credit Card required for bidding approval. Successful online buyers will be contacted by Longhorn Harley Davidson finance department on auction day to confirm form of payment. Buyers must be available by phone and/or email on auction day. 4. A 10% Buyers’ Premium will be added to the price of each bike purchased either live or online. 5. Sales tax will be charged unless the buyer has a dealer’s number. Dealers should present their dealer number at the time of registration. 6 All items in the sale are being sold, “as is, where is” without warranties or guarantees of any type and with all faults. AUCTIONEER AND SELLER EXPRESSLY DISCLAIM AND EXCLUDE THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Bidders should rely solely on their own inspection of all bikes prior to the sale and should satisfy themselves as to the usefulness and value of each. Any error in description made by the Auctioneer or Seller does not relieve the buyer or his agent of their responsibilities to inspect. Any dispute among bidders will be settled by the Auctioneer at his sole discretion, and his decision and remedy will be deemed final. Any deletions or additions to the sale will be announced by the Auctioneer, either before or during the sale. 7. Removal: Purchases should be removed as soon as possible or they may incur storage fees. Buyers assume all responsibility for removal & transportation of bikes. Auctioneer does not offer these services. 8. Titles: Titles will be mailed to the buyer by the dealership. 9. Online Bidding. Auctioneer and Seller are not responsible for any internet connection problems that may occur during the auction. Bidders should understand that sometimes connection or delay problems do occur while bidding live online. Auction lots will not be re-sold or brought back up for bidding because of internet problems. 10. Financing: Bidders are encouraged to come in to Longhorn Harley Davidson the week prior to the auction and get pre-qualified for financing. All decisions of the Auctioneer are final as to the methods of bidding, disputes among bidders, increments of bidding, and any other matters that may arise before, during, or after the auction. Auctioneer reserves the right to represent absentee bidders up to their maximum bid as well as the seller, up to any reserve, in the bidding process. Bidders are given notice that the Auction will be video/audio recorded and photographed. Auctioneer reserves the right to accept or reject offsite bidding via the internet, by telephone or by written absentee bid. BUYER UNDERSTANDS AND AGREES THAT THEY WILL BE CHARGED A $1,000.00 RESTOCKING FEE IF, FOR ANY REASON, THEIR INVOICE IS NOT PAID.
