This is an ONLINE ONLY auction. All bidders must register online to participate.
BIDDING
All bids must be placed online. No phone, email, written or in-person bids will be accepted.
All bids are binding. It is the bidder's responsibility to confirm accuracy of bid prior to bidding.
Bids are not reversible for any reason. Do not bid unless you are willing to purchase the item for the maximum bid amount that you have entered notwithstanding other bidder's actions.
BUYER'S PREMIUM
A 13% buyer's premium is in effect for this auction.
SALES TAX
Sales tax of 7% will be charged on all sales unless a valid resale/sales tax certificate is presented to the auctioneer or clerk at the time of payment.

A paid invoice must be presented to auction staff before purchased items will be released for pickup. If a third party is picking items up on behalf of the bidder they must provide a copy of the paid invoice before item/s will be released.
WINNER NOTIFICATION
Winning bidders will be emailed at the close of the auction. It is each bidder's responsibility to check this site and or email at close of auction to confirm win status. Check junk/spam folders.
Note: the payment invoice will have your registered name on it.
PAYMENT
Winning bidders will be emailed an invoice at the close of the auction which can be paid online or brought in person and paid at time of pickup. Note: the payment invoice will have your registered name on it.
Payment types accepted are:
Visa, Mastercard, American Express, Discover, Paypal, CASH
No other forms of payment will be accepted.
All sales are final. All items are sold AS-IS - WHERE IS. No refunds. No warranty is expressed or implied as to items present or future condition. Due to the nature of this sale Buyer waives all right to credit/debit card chargeback or refunds in full or partial.
SHIPPING / DELIVERY
Shipping and/or delivery is NOT available. All bidders must be able to pickup won items in person from the stated pickup location/s within the stated time frame. Neither the auctioneer or seller will assist in packaging any item/s.
LOADING
Loading assistance is NOT available. Winning bidder must be able to provide labor and/or equipment capable of safely loading purchased items. Neither the auctioneer or seller will assist in loading any item/s.
ABANDONMENT
Any unpaid or paid item not removed from stated pickup location within the stated pickup time frame will be considered abandoned and ownership will revert to seller.
No refunds will be issued for items that are paid for but not picked up.
Failure to pay for won items will result in bidder revocation.
RESALE LOCATION:
Under no circumstances will resale of purchased items be allowed to take place on Seller's or Auctioneer's property - prior to or after payment. Items must be removed from Auctioneer or Seller's property before resale to third party can occur.

WARRANTY
All items are sold AS-IS - WHERE IS. No warranty is expressed or implied as to items present or future condition.
LIABILITY
Buyer is purchasing item/s as-is with all faults and waives all right to any recourse or relief from any actual, consequential or other damages resulting from purchasing, loading, transporting or reselling purchased item.
SYSTEM / SOFTWARE FAILURE
Auctioneer reserves the right to cancel, extend, or reschedule the auction in the case of system/software failures or other event beyond the Auctioneer’s control.
DISPUTE RESOLUTION
If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Claims shall be heard by a single arbitrator. The place of arbitration shall be Paulding County, Georgia USA. The arbitration shall be governed by the laws of the State of Georgia. Each party will, upon written request of the other party, promptly provide the other with copies of all relevant documents. There shall be no other discovery allowed. The arbitration will be based on the submission of documents and there shall be no in-person or oral hearing. The arbitrator(s) shall not award consequential damages in any arbitration initiated under this section. Each party shall bear its own costs and expenses and an equal share of the arbitrators' and administrative fees of arbitration. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties.
Unless specifically stated in writing (by Take One Auctions LLC) this is a reserve auction and auctioneer and or seller reserve the right to bid on behalf of self or seller and or reject any and all bids without recourse.
ERRORS / OMISSIONS / NOTICE
Auctioneer reserves the right to add or delete items as/if needed due to errors, omissions or other reasons deemed necessary by Take One Auctions LLC. Auctioneer reserves the right to modify and/or append these auction rules with or without notice at any time. Please review the auction rules prior to participating in each auction.
