EQUIPMENT CONDITION: **All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE. (EXCEPT CLEAR TITLE) **All sales are final. **All bids are based on the inspection, evaluation, and desire of the bidder(s). BUYER'S PREMIUM: A 10% buyer's premium will be added to the high bid for each lot. This is a way of sharing the costs of conducting the auction between the buyers and seller. PAYMENT: Full payment is due immediately after the auction for the lawn care equipment. The credit card given at the time of registration will be used for the full payment of your invoice (IMMEDIATELY AFTER BIDDING CONCLUDES), unless you have made PRIOR arrangements with Wester Auction for an alternate form of payment. The vehicle buyer(s) must post a 10% NON-REFUNDABLE deposit immediately after the bidding ends. This deposit may be with cash, company check, or credit card (subject to a 3% processing fee). The balance of the amount due for each vehicle will be due by 5:00 PM on September 14, by cash or certified check made payable to Wester Auction. If the high bidder fails to pay for the vehicle on September 14, the vehicle will be offered to the next highest bidder at their high bid offered. ALL CREDIT CARD CHARGES WILL BE SUBJECT TO A 3% PROCESSING FEE, WHICH WILL BE SHOWN AS AN INCREASED BUYERS PREMIUM (13% vs 10%) If your credit card is declined for ANY REASON, you will have until noon the day after the card was declined to make full restitution, with another credit card. If you fail to pay your invoice IN FULL within the first 12 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you will be removed from our approved bidders list for future auctions. CREDIT CARD CHARGEBACKS: **Each Bidder agrees not to initiate a credit card chargeback with respect to any charges. **Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid. **With the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer. SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.) REMOVAL: The removal period will be from 11:00 AM until 5:00 PM on September14, 2017. Failure to meet the removal schedule and conditions may result in the loss of your purchases, without refund.
