Terms and Conditions of Sale
1. All goods purchased must be settled for WITHIN 3 DAYS following the ending of
the auction sale, and before being removed from the auction site. Risk and title
passes to the purchaser when the auction accepts the successful bid. Possession
remains with the auction company until the goods are paid for IN FULL
2. All items are sold ‘as is, where is’ and no warranties implied or guarantees
expressed or otherwise exists. The auction company accepts no responsibility for
errors in description ‘it being the sole responsibility of the buyer to inspect the
goods before the auction and satisfy themselves as to the condition, age, identity
and authenticity.” Auction companys description of the items are to be used as a
guideline only!
3. The auctioneer/auction company reserves the right to accept or reject any bid and
shall control the bidding at all times. At the auctioneers/auction companies
discretion, the bidding can be reopened if there is more than one bidder on. In all
cases of dispute, the auctioneers/auction companys decision…is FINAL.
4. All registered bidders are personally liable and financially responsible for any and
all bids placed within their respective bidding number. By virtue of accepting
terms and conditions of sale, you are agreeing to pay the winning bid amount in
addition to the buyers fee and gst, within the timeline dictated by the auctioneer.
Bid amounts DO NOT include gst.
5. Goods left on the premises after 5pm of the last pickup date, may become liable
for a minimum storage fee of $20.00/day, per item and or resold without notice to
the purchaser. Furniture and larger items are subject to a higher storage fee. Any
deficiencies will be charged to the purchaser. After 5pm on the last pick up day,
the credit/debit card used to register to bid on the auction will be charged the total
hammer price plus premiums and gst. At 10 days after the last pickup day, items
will be automatically forfeited to the auction company to do with as auction
company deems fit. The purchaser is responsible for picking up, or arranging pick
up for all purchased items. Shipping can be arranged at the cost of purchaser,
plus a $10.00 fee, by emailing Blaney Auction Services Ltd, at
mrblaney22@gmail.com and have the auction company ship items through
Canada Post.
6. Any and all purchases under this bid number are the sole responsibility of the
purchaser named herin.
7. A valid credit card will be required to register for timed auctions/online bidding
and will be subject to $1.00 USD fee to authorize the card.
8. The auctioneer/auction company reserves the right to accept or reject any bids
and/or bidders and shall control the bidding at all times.
9. Registered bidders must have the correct and valid address, phone number, first
and last name, and valid credit card. The auction reserves the right to reject
bidders based on invalid or inaccurate registered information and/or not being
able to confirm correct information with the auction.
10. In the case of the bidder being blocked from the auction, the bidder down will
become the leading bid on said item as the last accepted bid.
11. Credit cards will be subject to a surcharge of 3%. However, there will be no charge
for cash, email transfer or debit card.
12. We ship in Canada and in the USA only. No shipping outside of these countries at
this time. Auction invoice must be paid BEFORE shipping quote is given to ensure
our company you are aware of the shipping cost after the invoice total
13. USA buyers rule,…ALL USA buyers MUST pay for shipping costs and invoice total
with the registered card on file ONLY!!
14. A soft close in our action any many others means the first lot will close at the
advertised soft close time unless a bid is made with less than 3 minutes on the
clock timer. All lots will close with a staggering time separation of 10 to 25
seconds apart. If any bid is made with less than 3 minutes on a lot, then 3 minutes
will be added to the timer. Please note the timer on the count down to see the
scheduled time closing per lot.
15. Max bid or in live auctions known as a prebid, is meaning to leave a max bid. Just
click on the box indicating the next available bid and place your max bid you are
willing to pay. Your account will automatically bid on your behalf. If someone bids
against you, it will go up to the number you set as your mas.
16. We always recommend our bidders to view the items in person, however, if you
are unable to do so, please reach out with any questions so that we can try and
answer them for you or send additional photo or info if needed.
17. If your country imposes a tariff on Canadian goods leaving Canada going to you,
the auction company will pass the cost back to you, the customer. If there is no
tariff cost to the auction company, then there will be no additional charges added
to the invoice.
18. You are asked to be kind to the auction team/staff. It is a privilege to bid with the
company, not a right.
19. The auction team is NOT responsible for loading or unloading buyers or sellers
vehicles. If any help is needed by auction or staff, a charge may incur. As well,
please let it be noted that the auction company or staff is not held
responsible/liable for any damages or harm done to buyers/sellers items, vehicles
or persons inside or outside of the property. No liability for any
slips/falls/injuries/claims. No responsibility for items being broke, damaged, or if
theft has occurred while at auction house.
20. All items are SOLD AS IS WHERE IS. This is an auction company and not a store.
Everything is as is conditions with no warranties, exchanges, returns,or refunds.
We do our best to show any defects/damages in pictures or in written
descriptions. The auction company does not want to mislead anyone and will
declare if something is in no working order if we are aware of it. We pride
ourselves in being a family run business that prides itself in being honest and
truthful. However, we cannot test everything nor give a guarantee that anything is
100% accurate or in working condition as a lot of this is used items as well
.Auction company will use to describe, or declare any issues noted or if we
believe something is in new or working order, but is to be used as a guideline
only!
21. Auction company is not held responsible for any damages or items shipped out
that may have been damaged in transition from us to you. We package and do our
utmost to maintain safe arrival but once it leaves our hands and is in the hands of
Canada Post this is not our responsibility for damages and will not be subject to a
refund.
