ONLINE PERSONAL PROPERTY TERMS & CONDITIONS
PLEASE READ AND REVIEW THE TERMS AND CONDITIONS THOROUGHLY PRIOR TO BIDDING. IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS, PLEASE DO NOT BID. BY BIDDING ON THIS AUCTION, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE THE ITEM(S) UNDER THE FOLLOWING TERMS AND CONDITIONS:
GENERAL TERMS OF THE AUCTION: Each bidder who registers must be verified through a credit or debit card at a fee of $1 from the verification company that will be charged to the bidder's card, BUT THEN REIMBURSED ONCE VERIFICATION IS MADE. Information is subject to change. All lots are sold as is, where is, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. All sales are final. No credit card charge backs will be allowed. All statements made prior to the sale of any item take precedence over written material and any prior verbal statements. Stroud's Auction Service, LLC is not responsible for accidents, thefts, errors or omissions.
PREVIEW DAYS: Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Bidders are encouraged to attend the scheduled Preview Day (Saturday, December 26, 2015 from 10 AM to 2 PM EST). Please utilize the Preview Day to inspect items you may be interested in bidding on.
BUYERS PREMIUM & SALES TAX: There is a 10% buyers premium added to your total purchase. Please factor this into your bidding online. Sales tax will be collected on the total, if applicable, at a rate of 7% per Indiana sales tax laws.
REGISTRATION: In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to insure good communication between Stroud's Auction Service, LLC and the bidder throughout any transactions. We also require you to register with a credit/debit card. The card information is kept confidential and is not automatically charged when you are a successful bidder. Stroud's Auction Service, LLC reserves the right to preclude any person from bidding if there is any question as to the person's credentials, mental fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their accounts. If the registered bidder's username is offensive to Stroud's Auction Service, LLC or is in their sole opinion detrimental to bidding activity, then Stroud's Auction Service, LLC reserves the right to delete the bidder from bidding or unilaterally change the username with notification to the bidder. When using the website you must obey any and all local, state and federal laws. Violations will result in termination of web site use privileges.
PAYMENTS: For this auction we will accept cash, cashier's checks or Paypal for credit/debit cards. If the buyer chooses to pay by Paypal, there will be an additional 3% buyer's premium applied. There is no additional buyer's premium for cash or cashier's checks. All cashier's checks are to be made out to STROUD'S AUCTION SERVICE, LLC. Any transaction necessary to collect insufficient funds will have a $25 fee imposed. If you are a successful bidder, you will receive an email detailing the date(s) and location(s) where you may pick up your items. At that time you may pay for your purchase using paypal (at least 24 hours prior to pickup), or bring cash or a cashier's check at pickup. After the pickup date if any payment is still owed for items not picked up, a court date will be set in Harrison County, Indiana to collect funds along with court costs and the items disposed. TAX EXEMPT form copies of originals will be the only forms accepted. Hand written or verbal Tax numbers will not be allowed.
PICK-UP DAY: All items must be picked up on location on Saturday, January 9 from 10 AM to 2 PM EST. Any lot not picked up by Saturday, January 9 may be removed from the property and discarded and a court date may be set up in Harrison County, Indiana to collect funds along with court costs.
NO SHIPPING PROVIDED: It is the successful bidder's responsibility to provide their own shipping of any items deemed neccessary by the succesful bidder.
UNPAID BALANCES: The purchaser agrees to pay all reasonable attorney fees and costs incurred by Stroud's Auction Service, LLC in the collection of funds. The purchaser also agrees that a fee of 10% per month be added to the balance of any unpaid balance due Stroud's Auction Service, LLC and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Harrison County, Indiana.

TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software, internet or any other online auction-relate technologies, Stroud's Auction Service, LLC reserves the right to extend bidding, continue the bidding or close the bidding. Neither the company providing the software, not Stroud's Auction Service, LLC, shall be held responsible for failure of the sotfware to function properly for any reason.
