THIS WILL BE A LIVE WEBCAST AUCTION beginning at 10:00 AM on Monday, February 20, 2017. What this means is that you can participate in 3 ways: 1. Place bids at anytime before the auction date (if yours is the final high bid, then you will win the item, at the high bid, EVEN IF IT IS LOWER THAN YOUR max bid) 2. Bid in real time on your computer as the lots close (bidding updated every second) 3. Come to the restaurant and bid at the live auction CONDITION: **All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE. **All sales are final. **All bids are based on the inspection, evaluation, and desire of the bidder(s). PREVIEW: We will open the restaurant on Monday, February 20, prior to the live webcast auction beginning at 9:00 PM. If you want to preview the items and cannot come during these hours, please call Randy Wester at 984-500-9395 or John Martin at 919-522-9802 to schedule a time to visit the restaurant. PAYMENT: Full payment is due immediately after the auction. Live bidders at the auction may pay with cash, good NC check, or credit card. Payment with cash will earn a 3% discount on the entire invoice. Online bidders will pay with the credit card given at the time of registration for the full amount of your invoice. If your credit card is declined for ANY REASON, you will have 24 hours to make full restitution, with another credit card or cash. If you fail to pay your invoice IN FULL within the first 24 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you may be removed from our approved bidders list for future auctions. REMOVAL: The facility will remain open for 2 hours after the last item is sold for the benefit of the live bidders at the auction. Due to the limited removal time, we are having the hoods professionally removed and readied for loading by the buyer(s). The fee for this removal will be added to the buyer's invoice. The fee amount is listed in the description of the hood being sold. The faclility will be open from 9:00 AM until 5:00 PM on Tuesday, February 21 and Wednesday, February 22 for removal. EVERYTHING HAS TO BE OUT OF THE BUILDING BY 5:00 PM ON THURSDAY, FEBRUARY 24. Failure by the buyer(s) to meet the removal schedule and conditions may result in the loss of your purchases, without refund. The buyer is to provide all manpower, tools, and equipment needed to remove the items from the facility. In the case of a large built-in item (hood system, walk in cooler, etc.) the buyer may be required to hire a professional removal company, that is fully qualified and insured. This will be stated in the description of the item being offered. SELLING MULTIPLE LIKE ITEMS: if we sell multiple like items to more than one buyer, selection will be on a first come basis. (Example: If we sell dining chairs to more than one buyer, then the first buyer to show up to get their items, will get the first selection. If you are late getting there, you will choose from what is remaining.) SALES TAX: The State of NC does not require us to collect sales tax on the items sold in this auction. CREDIT CARD CHARGEBACKS: **Each Bidder agrees not to initiate a credit card chargeback with respect to any charges. **Each Bidder further agrees that initiating a credit card chargeback is a DIRECT VIOLATION of the Terms and Conditions agreed upon by the bidder when registering to bid. **With the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, the bidder authorizes such bank, credit card company, or other financial institution to deny any credit card chargeback and to re-credit all amounts to the account of the Auctioneer.
