Purchasers may incur fees to resell the firearm. 8.     For Pre-1898 and Percussion Firearms, a FFL is not required, but buyers need to email copy of driver’s license before shipping of firearms. 9.    Whipple Auctioneers may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification that Whipple Auctioneers may request, including but not limited to: Driver License, photocopies of credit cards, Social Security card, or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 10.    We want you to be happy with your purchases! If you have any questions about the merchandise the time to ask questions is well in advance of the live auction. No returns are allowed. 11.    Any controversy or claim arising out of, or relating to this contract, or the breach thereof, shall be settled by arbitration in accordance with the rules of American Arbitration Association, and judgment upon the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Any and all disputes, whether by arbitration or otherwise, shall be venued, heard and decided in Stark County, Ohio. 12.    All firearms transfers will be in strict accordance with all Federal, State and local laws. Be sure to check your state and local laws before bidding. If you are unable to purchase or own a firearm according to your residency laws, do not bid on these items. Federal Law disallows anyone else from accepting the transfer. 14.    Modern firearms sales to non-licensed bidders who are picking up guns at this auction will require the completion of a 4473 and NICS background check. If you are denied by FBI / NICS background check, you will not be able to take possession of the firearm. Licensed bidders, i.e. Federal Firearms Licensees or Curios & Relics License holders must present a current signed copy of their license. (C&R licensee purchases must conform to the ATF C&R requirements). Non-Residents of Ohio may NOT pick up modern handguns. 15.    Any firearms shipped are legally required to be shipped to an ATF licensed dealer within your state of residence for transfer and pickup. You will be responsible for all shipping and transfer costs incurred. Handguns will only be sold to those persons 21 years of age or older. Dealers are bound by these minimum age requirements. Since all firearms sold are collectible items, Whipple Auctioneers does not test the safety or warrant functionality of these firearms.
