Description
Spring Artwork Auction Fantastic Auction selling over 350 lots. Hundreds of original fine art paintings, Bronzes, western artwork, works on paper, ceramics, and more.
Best of the West Auctions highly recommends a high speed internet connection to participate live online. Best of the West Auctions will not be held responsible for delayed bidding resulting in your bid being placed at two or more increments after you clicked "Bid Now." Please Note: All bidders and others participating auction agree that they have read and fully understand these terms and agree to be bound thereby. Identification: All bidders are required to fill out the Icollectorlive.com Bidder Approval form. We require a credit card number on file to qualify online bidders. Shipping: Buyer agrees to pay all shipping & packing fees as well as any duties & taxes if shipped internationally. Shipping & Packing will be handled by PakMail of Colorado Springs. Once items have been paid for, they will be released for shipping. Bidders will then pay PakMail directly for shipping & packing. You may also arrange to have your items picked up from our Gallery. Addition to or withdrawal from sale: The auction company reserves the right to withdraw from sale any of the items listed or for sale at this auction. Dispute between bidders: If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. In the event of an operational error resulting a dispute between an internet sale and a live floor bidder, the live floor bidder will take precedence and become the high bidder. The live auction floor bidders have the ability to breakdown the increment, online software does not permit online bidders to do the same. Please review the increments prior to the auction. Reserve: In accordance with state law, we announce all items have a reserve of at least one dollar. The auction company reserves the right to reject any and all bids. The decision of the auctioneer shall be final and absolute. Some items of property may be offered subject to a "reserve" or confidential minimum price below which the item will not be sold. In such instances the auctioneer may implement the reserve by bidding on behalf of the consignor, house, owner or designated bidder. Condition of items sold: The auction company shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging, or any imperfection not noted. All items are sold "as is – where is" and without recourse. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. We attempt to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question. Compliance with term of sale: In default payment of bills in full within the time herein specified, the auction company, in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise as liquidated damages. Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice, and deficiency, together will all expenses and charges of resale, will be charged to the defaulting purchaser. Additional terms and conditions: Any additional terms or conditions of sale may be announced prior to auction. Removal: Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be delivered only on presentation of paid bill. Auction Company shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased, but not paid for and removed within the specified time. Non-delivery and responsibility: Auction Company shall not, in any event, be liable for any matter or thing, including non-delivery to any purchaser of lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled to it. All sales are final: When the auctioneer says "sold" title immediately passes to the successful bidder. No claims will be allowed after goods are removed from premises. Personal and property risk: Persons attending during exhibition, sale or removal of goods assume all risk of or loss to person and property and specifically release the auctioneer, auction company and/or its' agents from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held. Agency: The auction company and auctioneer are acting as agent only and are not responsible for acts of their principals. Default on payment: Invoices will be sent from Icollector after each session. Payment must be recieved within 7 days of the auction end. If unpaid after one week, the buyer agrees to & allows Best of the West Auctions to apply the charges to the credit card used at the time of registration. Should any purchaser/bidder fail to pay all sums due and owing to auctioneer at time of sale, then purchaser/bidder agrees to pay in addition to principal sum owing 1.5% per month interest compounded monthly on said unpaid principal balance due and accrued interest. In addition, purchaser/bidder agrees to pay in addition to the above all necessary collection costs and reasonable attorney fees incurred by Auction Company whether or not a lawsuit is started. Collection costs include all court costs, service costs, investigation costs, title search and all other costs incidental to either collecting the sums owed to Auction Company or securing the return of property in question. Internet bidders agree that if payment is not received within 10 days of receipt of total, Best of the West Auctions will have the right to charge your credit card on file and ship the item(s) to the address supplied when registering. Buyer's premium: A 22% buyer's premium will be in effect for the internet auction bidders.
