IN OUR EXCITMENT OVER THE QUALITY AND QUANTITY OF THE ITEMS WE ARE GOING TO BE SELLING, WE FAILED TO UNDERSTAND THAT THE 10 FT WYSONG BRAKE DID NOT BELONG TO TOMMY, BUT WAS ON LOAN FROM A FRIEND. THEREFORE, WE CANNOT SELL THE BRAKE. THIS IS COMPLETELY THE FAULT OF WESTER AUCTION.

Description	Tommy Newber is retiring after over 30 years in the commercial refrigeration business. He has sold the real estate and must be out during the first quarter of 2017. We have 1000s of items that must be sold at some price. There are no reserves on anything. He wants to get on his boat and go fishing. There will be a series of auctions, selling different types of items. This first auction will include sheet metal equipment, material handling equipment, vehicles, generators, trailers, forklifts, and more. ****************SPECIAL NOTICE *********************************** Tommy has asked us to change some data, add some items, and delete a couple of items, so we are extending the auction until January 16. We hope this does not inconvenience anyone. Terms and Conditions

CONDITION: All items are sold AS IS, WHERE IS with NO WARRANTY or GUARANTEE. All sales are final. All bids are based on the inspection, evaluation, and desire of the bidder(s). In the event any item is lost, damaged, or stolen, before it is removed from the auction site, the buyer will be limited to a refund of the purchase price. The seller and/or Wester Auction will not be liable for more than the purchase price of any item. PREVIEW: You may request an appointment to inspect the items being sold by calling Randy Wester at 984-500-9395 or John Martin at 919-522-9802. You must call AT LEAST 24 HOURS IN ADVANCE. We will try our best to meet your schedule and get you in the buildings when it is convenient, but dates and times ARE NOT GUARANTEED. PAYMENT: Full payment is due immediately after the auction. The credit card given at the time of registration will be used for the full payment of your invoice, unless you have made PRIOR ARRANGEMENTS with Wester Auction for an alternate form of payment. If your credit card is declined for ANY REASON, you will have 24 hours to make full restitution, with another credit card or cash. If you fail to pay your invoice IN FULL within the first 24 hours, Wester Auction reserves the right to sell the items on your invoice. In addition, you may be removed from our approved bidders list, and not be allowed to purchase from us in the future. REMOVAL: The removal period will be January 17 through January 20, 2017, between the hours of 9:00 AM and 4:00 PM. Removal of all items will be the responsibility of the buyer. The buyer will provide all manpower, equipment, and tools necessary for the removal of the purchased items. The buyer agrees to meet the removal schedule posted. Any item remaining after the removal period will be deemed abandoned and will be discarded at the discretion of the seller.

Payment Terms	Unless you make arrangements with Wester Auction BEFORE January 16 for an alternative form of payment, your credit card will be charged immediately after the auction. If you would rather make payment with some other form, we accept CASH, CERTIFIED CHECK, or WIRE TRANSFER. Payment MUST BE COMPLETED on January 17 by 4:00 PM.

Shipping / Pick Up

If you want your items shipped, we will assist you in finding a company in the local area to handle this for you. We will not be offering shippping options through our company. Removal is the responsibility of the buyer. The buyer must provide manpower, equipment, and tools necessary to complete the removal. Removal dates are January 17-20 from 9-4.
