Description
Hartley-Melvin-Sanborn School District is selling real and personal property that is no longer in use by the district by this absolute online only auction. This is a great opportunity to purchase your own storage building or any one of the finely maintained personal property items.
REAL ESTATE TERMS: Selling is a legal description that includes improvements. Abbreviated legal is: Lots 9, 10 and 11, Block 8, Woodward's Third, Hartley, O'Brien County, Iowa. Buyer of the real estate will sign a purchase agreement and deliver a 10% earnest deposit at the Klaassen Realty office at 43 1st Street SE at 10:00 AM on September 21, 2017. A continued abstract will be delivered to buyer for title examination prior to closing date. Possession and closing will be October 2, 2017 at the Klaassen Realty office in Hartley, Iowa. School district is exempt from real estate taxes so no tax proration for this property. Any personal property or debris remaining at closing becomes property and responsibility of buyers. Property is in Zoning district R-1, please contact Hartley City offices for determination of regulations for your intended use of the property and utilities available. Klaassen Realty is providing brokerage services, is an agent for and is representing the Seller at this auction. The Auctioneers, sellers, or any member of their staff make no guarantee as to the authenticity, of any particular age, year of manufacture, model, make, mileage, hours, condition, or defect of any lot or item being sold. Bidders are encouraged to make their own physical inspection and rely solely on that inspection before bidding. Small loader will be available only at that time to assist loading. All other methonds of lifting, towing, and/or hauling are the Buyers responsibility. The purchaser will also be charged an additional $20.00 per item disposal fee. No refunds will be given. PERSONAL PROPERTY PAYMENT OPTIONS: Accepted forms of payment for this auction are credit card only (Visa, MasterCard, American Express or Discover) with an additional 3.5% electronic fee on all credit card purchases. Purchaser grants a security interest in purchased items. If, for any reason, payment is not made in full, Klaassen Auction has the right to repossess items, even from private property. PAYMENT TERMS: Sales tax, when applicable, will be charged on the purchase price. Taxes, fees, shipping, handling, insurance, storage and security charges are Buyers expenses, and will be calculated and rendered due at the sale of the property. Payment must be made in full by the Buyer, immediately upon the completion of the auction by VISA, MasterCard, American Express or Discover. All payments in US funds only. If action is necessary to enforce the terms of this agreement, purchaser agrees to pay attorney fees and costs associated with collection or action. Interest on overdue amounts will be paid by purchaser at a rate of 2% per month/24% annual, or at such other maximum rate allowed by law. Auctioneer reserves the right to periodically change the terms and conditions of the Agreement, which shall be effective immediately upon posting. It is the Bidders responsibility to review any and all changes made to these terms and conditions prior to bidding on property. Auctioneer reserves the right to add or withdraw property from the auction, and/or regroup items. Auctioneer reserves the right to sell property absolute or with reserve, at Seller discretion. The Seller does have the right to make the final bid and the Auctioneer does have the right to bid on behalf of the Seller. The auctioneer reserves the right to open the bid as the result of a tie bid or discrepancies in the bid.
