Terms and Conditions of Auction are:
*2017 New Payment Terms - We will NOT accept credit card payments on invoices over $4000 (including premium). Checks, cash, travelers checks, certified funds, or EFT are acceptable on all transactions. We reserve the right to hold items until the funds clear our bank account
•All items in this catalogue are offered by Hutter Auction Galleries LLC (also referred to as Hutter Auctions NYC) either as agent for the consignor or as owner.
•Everything is sold AS IS, WHERE IS and without recourse. While we do our best to describe the items properly, neither Hutter Auctions, nor the consignors make any guarantees or warrantees to the accuracy of these descriptions.
•We do NOT guarantee signatures on any work of art that we offer in this (and any other) catalog. The only thing we do guarantee is the medium in which a particular work of art is executed in.
•Hutter Auctions reserves the right to withdraw or combine any lots listed in the catalogue at its sole discretion. Hutter Auctions and its auctioneers have final say in any dispute among bids or winning bidders. Hutter Auctions' records shall be conclusive in any dispute.
•The purchase price payable by a buyer at auction shall be the final bid plus a 20% buyer’s premium (23% buyers premium on purchases from our website and 25% from Liveauctioneers.com). All purchases are subject to NYC sales tax rate of 8.875% unless a valid resale certificate is presented. A resale tax form must be completed in full prior to time of purchase. Items being shipped out of state are also exempt from sales tax IF they are picked up directly from our gallery by a licensed and certified Interstate Carrier and has legal proof of such (UPS, Bill of Lading with ICC Numbers etc.)
•No merchandise shall be given out prior to the end of the entire auction session. Hutter Auctions reserves the right to hold merchandise paid for until all funds are received in our bank. Invoices must be paid for in full before any item is removed from our premises.
•Hutter Auctions takes payment in the form of major credit cards, cash, certified checks, personal or business checks, or wire transfers (EFT). We will charge a $30 fee on all checks, wire transfers or credit cards returned as unpayable. We do NOT accept paypal.
•Items in the catalogue may have a reserve which is a confidential minimum bid price agreed to between Hutter Auctions and the consignor. Any reserve/minimum bid will be either at or below the published low estimate in our catalogue. The Auctioneer may open bidding and advance bidding on behalf of the seller, up to the amount of reserve.
•Hutter Auctions reserves the right to refuse a bid from a potential buyer who has not established themselves with management prior to the auction.
•Successful bidders must pay for the entire invoice before any items are removed from our galleries. All items must be paid for within 2-3 business days from the date of auction and ALL items must be removed within 5 business days. Any item not removed in this time are subject to a storage rent of $25.00 per item per day, payable to Hutter Auctions, or an outside storage company. All storage rent and invoices must be paid in full to retrieve items sent into storage.
•Buyers are responsible for making all shipping arrangements of their purchases.
•Hutter Auctions does not guarantee the authenticity of any signature that appears on any work that we offer for sale unless so stated at the time of auction; the only guarantee is the medium in which a particular work is executed. All weights and measurements are approximate. Any condition statement given, as a courtesy to a client, is only an opinion and should not be treated as a statement of fact.
•Hutter Auctions shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging.
