The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the Seller. 5. Titles will be disbursed on auction day only if payment is made in cash; otherwise they will be mailed when the check clears the bank. 6. Sales tax will be added to the purchase of all taxable items. Dealers who purchase for resale must file their resale permit numbers. 7. Purchaser does hereby indemnify and hold harmless Auctioneer and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased. Purchaser assumes all risk and liability whatsoever resulting from the use of the item(s) sold hereunder; and shall defend, indemnify, and save harmless Auctioneer and Seller from any liability. 8. If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at their option may (1) resell the property publicly or privately, with purchaser being liable for the payment of any deficiency plus all costs incurred, or (2) cancel the sale, retaining liquidated damages on all payments made by purchaser, Auctioneer commission and all other incidental damages will be charged. 9. AUCTION FORMAT: This will be an Online Only Auction with no live bidding. Bidding on Lot #1 will close at 5 PM EST on 9/13/17. Lots #2-253 will have a staggered ending with one lot ending every 45 seconds. 14. SOFT CLOSING: This Auction will feature a soft closing. If a person bids on an item within 1 minute of the item closing it will extend the bidding by 1 minute to allow the person who was outbid to bid again. 15. Payment: Payment required No later than the Pickup day on Saturday Sept. 16th, 2017. There will be a 15% Buyer Premium for all online absentee bids. Example. If you bid $100 on an item. There is a 15% Buyer premium added to the bid price for a total of $115. Maryland 6 % Sales Tax will be charged. 16. The Auction Co. reserves the right to extend the bidding time if an error should occur with the online server. 17. Auctioneers reserves the right to Add/Remove items, modify descriptions or cancel the auction at any time. 18. Payment Terms
Payment due in full no later than the Pickup day on SATURDAY Sept. 16th, 2017 from 2 PM - 5 PM. Payment preferred via Visa/MC/Disc/Amex, Cash (Exact change requested) or Local Approved check. Must have valid credit card to register. 15% buyer premium charged on all items. Items purchased will be applied to credit card that you placed on file when you registered at 2 PM on Thursday Sept. 14th, 2017 unless you notify the Auction Co. of your wish to make payment via another means. If you wish to make an alternate payment by Cash, Check or Different Credit Card than what is on file please reply to this Email of call Jeff Smith at 410-835-0384 on Thursday 9/14 before 2 PM. Payment by an Alternate form of Payment will not decrease the Buyer Premium.
Local Pickup is recommended. Items must be picked up at the Auction Site on Saturday Sept. 16th, 2017 from 2 PM - 5 PM. This is the only time that we are scheduled to be onsite for Pickup. Buyer is responsible for removing all items. Buyer is responsible for bringing any required manpower (Personnel to carry your items), tools, boxes, wrapping paper, tape, blankets, wheel cart or dollies needed to remove your items from the property. We will have Staff onsite to assist you in locating your items but they may not be available to assist in carrying of items. If you can't pick your items up during the time scheduled, you are responsible for designating someone to pick your items up. Items not picked up will be considered abandoned and will be disposed of at the discretion of the Auction Company and/or property owner. If you want your small items (SEE notes below) returned to our Auction Facility that is possible. There will be a minimum Charge of $25 for the 1st item and $10 per additional item if the items will fit in one of our vehicles. If we have to wrap & box glassware or other delicate items there will be an additional charge. If you purchase a large quantity of small items or midsize items and we have to hook up a small open Trailer it will be a minimum of $100 for 1 item and $10 per additional item(s). If you purchase Large items, IE any type of furniture (Not including Oversized items including Appliances, Pianos, Vehicles, Tractors or other large items) and we have to use a larger Diesel Truck and Enclosed Trailer it will be $200 for the first item and $25 per additional large item to return them to our Auction Facility. If you purchase a larger item that requires specialized moving equipment you will need to call us for a quote. These fees will be payable in Cash at the time your items are picked up. Notes: A Small item is described as an item that can easily be placed into a small box or beer flat and transported in the passenger area of a car. These items could include: Small collectibles, glassware, China, pottery, small prints or pictures, hand tools etc… A Midsize item is described as an item that can easily be carried or moved by 1 person and may include: lamps, larger prints, faux plants, computers, side chairs, end tables, electronics, small TV's or larger boxes of items etc… A Large item is described as an item that may require two people or a person with a hand cart to more and may include sofa's, upholstered chairs or furniture, bookcases, Hutches, Dining room tables, small safes, large TV's, beds, dressers, entertainment centers ect…An Oversized item is described as an item that requires specialized equipment to move including but not limited to Lg. Appliances, Pianos, Vehicles, Tractors, Boats, Motorcycles, Gun Safes or other large items. The Auction Co. staff will determine what size category your items fit into.
