1- This auction is an absolute auction and items will be sold to the highest bidder at public outcry as determined by the Auctioneer.
2- The Auctioneer has the final say in all price disputes and has the option to reopen an item for bid should a tie or mistake be brought to his/her attention.
3- All winning bids will be considered a binding and legal obligation on the part of the person who holds the winning bidder number.
4- All participants agree to hold harmless ZarKelley Auctions, Inc and any of its employees for any statements made as to the workability, value, condition or overall evaluation of an item unless it is provided in writing prior to the sale.
5- ZarKelley Auctions, Inc and the Auctioneer will make every attempt to explain and describe items with all information at their disposal and all participants agree to hold harmless the Auctioneer and ZarKelley Auctions, Inc for any information not forwarded as a result of unknown omissions.
6- Winning an item and not paying for it as prescribed by the check in and out procedures of ZarKelley Auctions, Inc will forfeit the ability to participate in future ZarKelley Auctions, Inc events furthermore; if an item is removed from the premises without paying it will be considered an act of theft and will be prosecuted to the fullest extent as allowed by law in the public courts of Weber County.
7- When in doubt ask questions, failure to do so is not the fault of ZarKelley Auctions, Inc or the Auctioneer and anyone who participates agrees to hold themselves accountable for all information they have to base their decisions on when bidding on an item.
